About Expulsion Hearing

What is an Expulsion Hearing?

Students are referred for expulsion hearings by school sites. A Student, Family, and Community Support Department (SFCSD) administrator reviews the referral/case to see if it is appropriate to proceed with a hearing.

If the SFCSD administrator determines that it is appropriate to proceed to an expulsion hearing:

  • The Expulsion Panel is made up of other administrators from the SFCSD
  • The panel decides whether or not to expel a student, or if a student needs a new placement
  • Administrators on the panel also complete a rehabilitation plan for each student
  • Final approval on whether or not a student is expelled comes from the Board of Education

Expulsion Hearing Timelines

  • Expulsion Hearings must be held within 30 school days of the date student began suspension
  • Student/Family must be notified of the date and time of the hearing at least 10 days prior to the hearing date
  • Student/Family can request a postponement of the hearing one time, to be rescheduled within 30 calendar days
  • After the hearing is held, SFCSD must notify the student/family in writing, within three school days, of the panel’s decision whether or not to expel
  • If panel decides to expel, the case is forwarded to the Board of Education for final review and decision. The decision of the Board should be made within 40 school days of the date the student began suspension (or 40 school days plus 30 calendar days if student/family requested a postponement of original hearing date)
